Empire Earth certainly is loosing players. However, I think you're overestimating several causes as well as ignoring a lot of other causes.
First, you need to keep in mind:
1) Most people have school right now (compared to the summer, when most do not). Since holiday break is coming up soon, people have exams, etc. These are mostly seasonal losses.
2) Again, holidays. Most people get busy with non-empire earth related stuff. These are also mostly seasonal losses.
3) Lots of people are leaving because let's face it, Empire Earth is extremely old. Don't expect the same players who stuck around to stick around forever, new games come out, people get bored with Empire Earth, or their priorities change to the point where they're not interested in it anymore, etc. These players are permanent, or at least long-term losses.
Let's face it, Baboon, Empire Earth was loosing players long before the server shutdown. The game was steadily declining, and everyone who had been around for awhile knew it. We lost a ton when that happened, since a lot did not know about any new system, too, but we've also gained new players, and from what I can tell the rate at which we are currently loosing players (for good) is lower than when we were on the old system.
So, now to answer the questions you've raised in your post...

The losses you're currently seeing are due to people's lives getting very busy with holidays, and school. These losses are never permanent, since amazingly, when people aren't extremely busy the amount of players rises.
There are also plenty of newcomers, I get asked a question by a first time user or player every few days (at the most infrequent). A lot of them do not stay though, because the community does not welcome them or treat them very well at all.

And as I've already mentioned, considering how un-friendly the community at large is to new players, do anything you can to change that. Unless that happens, all the advertisement in the world won't do anything.

But also the fun isn't the same in the lobby. I don't know why but i think the design got a lot to do with it.
The reason we're loosing so many now is people are busy. These are not permanent losses.
The reason we're having permanent losses among people who've played for a long time, is that they're more likely to be older... You can figure the rest out I'm sure.
I don't think we're loosing very many players due to bans and mutes at all. Most people who are muted get muted repeatedly, so they're definitely not leaving are they? Pretty much all of our bans are for cheating or for offenses that could get the lobby shut down (porn, hacking save-ee, etc.). I'm not sure why people would quit over those bans, can you elaborate? And, if you mean the people who are
being banned, well, do we want them to stay?

Empire Earth is already loosing players because of this reason. I quit YEARS ago, when there were comparatively massive amounts of people still playing because I didn't feel there were enough players--it wasn't possible to get all-expert games consistently or regularly at that time, and it sucked. It's still not possible, except
maybe for Pre, and this is with the bar for expert in practically every setting being lowered considerably compared to the past.
I obviously came back, but I know dozens of players from that age who did not, and will not because the community is simply too small for them, and virtually no one left even plays the settings they like the most.
New players also leave for the same reason, not only is the community actively hostile to them, but it's small. Go make a smurf name and see how many games you get kicked from after you tell the players it's your first game on EE, ever. Then again, new players came to EE and left it YEARS ago as well.
My point is, this isn't a new phenomenon, people leaving due to community size has been around for a very, very long time, and isn't going away, so to sound the alarm that, at a time where everyone is ridiculously busy, not a lot of people are online and therefore some people might start to leave because the community size is small is well... Kinda naive.
